Omfanget av helsepersonells reservasjonsrett har nylig vært gjenstand for debatt i Norge. Vi spør om leger bør ha reservasjonsrett ved utførelse og henvisning til assistert befruktning, og drøfter argumenter for og imot ved hjelp av et rammeverk med sju kriterier for vurdering av reservasjon. Reservasjonsrettens grunnleggende dilemma er hvordan to viktige hensyn, henholdsvis pasientens rett til behandling og hensynet til helsepersonellets moralske integritet, best kan ivaretas. Det argumenteres for at leger bør ha rett til å reservere seg mot (...) å utføre, assistere ved og henvise til assistert befruktning generelt hvis begrunnelsen er hensynet til befruktede eggs moralske verdi. Videre finner vi at leger også kan ha en moralsk rett til reservasjon mot å utføre, assistere ved og henvise til assistert befruktning for likekjønnede, men da på nærmere spesifiserte vilkår.Nøkkelord: reservasjonsrett, assistert befruktning, samvittighet, moralsk integritetEnglish summary: Should physicians have the right to conscientiously object to assisted reproduction?The extent of the healthcare worker's right to conscientious objection has recently been debated in Norway. This article asks whether physicians should have a right to conscientious objection to the performance of, and referral for, assisted reproduction, and discusses arguments for and against the same, utilizing a framework of seven criteria for the evaluation of conscientious objection. The fundamental dilemma of conscientious objection is how two important considerations can be reconciled: the patient's right to treatment, and the protection of the healthcare worker's moral integrity. It is argued that physicians should have the right to object to performing, assisting with, and referring for assisted reproduction generally when the objection is grounded in the moral value of the embryo. Furthermore, physicians may also have a moral right to object to performing, assisting with, and referring for assisted reproduction for same-sex couples, but only on conditions that are further specified. Artikkelen vurderer hvorvidt ID-kravet, som begrenser asylsøkeres anledning til å søke arbeid, er etisk velbegrunnet innenfor rammene av en liberal rettskultur. Videre anlegges et konsekvensetisk perspektiv fordi ID-kravet er konsekvensetisk begrunnet, og det kan da foretas en immanent kritikk. Det vises at ID-kravet innebærer en begrensning av asylsøkeres negative og positive frihet, og at forsvarere av ID-kravet dermed må bevise at kravet har så gode konsekvenser at det legitimerer en slik begrensning av asylsøkeres frihet. Både generelle overveielser av ID-kravets fordeler (...) og ulemper og konkrete data tilsier at bevisbyrden ikke er oppfylt. A consequentialist assessmentThe article evaluates whether the Norwegian ID-demand, which limits asylum seekers' opportunity for work, is ethically well founded within the limits of a liberal, legal culture. The argument operates within a consequentialist normative theory because the ID-demand is justified in terms of its consequences, and an immanent critique of the demand can therefore be carried out. It is argued that the ID-demand imposes restrictions on the negative and positive liberty of asylum seekers, and defenders of the ID-demand will then have a burden of proof to show that the demand has such good consequences that it will legitimise these restrictions. Both general considerations and specific data clearly indicate that this burden of proof is not satisfied. Hence, one must either provide new data that indicate that the ID-demand after all has better consequences, defend the ID-demand in terms of something other than its consequences or reject the ID-demand. Dette nummeret av Etikk i praksis består av to deler, en temadel og en åpen del. Nummerets temadel dreier seg om irregulær migrasjon. Irregulære migranter skaper etiske, rettslige og politiske utfordringer for liberale velferdsstater i Europa. En irregulær migrant oppholder seg nemlig innenfor en stats grense, men er uten oppholdstillatelse. Dersom man aksepterer at stater har suveren rett til å bestemme over hvem som kvalifiserer seg til oppholdstillatelse og ikke, vil personer uten lovlig opphold reise følgende spørsmål: Har staten (...) et ansvar for å ivareta denne gruppens sikkerhet og velferd? Det er viktig å påpeke at irregulære migranter i liberale velferdsstater ikke er fullstendig rettighetsløse. De fleste liberale velferdsstater anerkjenner at de har sivile rettigheter samt et minimum av sosiale og økonomiske rettigheter.1 Territorielt og til en viss grad juridisk befinner de seg altså innenfor staten. Samtidig er de ekskludert fra de fleste sosiale og økonomiske rettigheter, og kan i prinsippet sendes ut av landet når som helst. På denne måten befinner de seg allikevel utenfor staten. I praksis er irregulære migranter altså på samme tid både innenfor og utenfor staten. Dette nummerets temadel inviterer til en normativ diskusjon om liberale velferdsstaters politikk overfor irregulære migranter. Og, ikke minst, hvordan samfunnet bør behandle denne gruppen innbyggere. Blandt de værker, der er overleveret under Platons navn, er den forholdsvis ukendte Theages. Det er en ganske kort dialog, som ikke desto mindre behandler et kernespørgsmål i Platons forfatterskab: Hvordan opnår man visdom? Den har tydelige referencer til en række kendte passager i Platons værk, fx iForsvarstalen, Symposion, Staten og Theaitetos. Desuden viser den nogle af de berømteste sider af Platons Sokrates: Hans guddommelige tegn, hans særlige ironi, hans forhold til sofisterne og til de mennesker, der vil følge ham. (...) Dialogen er både filosofisk og litterært vanskelig at fortolke og er ofte blevet anset for uægte. Den platoniske dialog Theages giver en oversættelse af dialogen, gennemgår dens forskningshistorie og fortolker den gennem en omhyggelig læsning og en diskussion af dens vigtigste temaer. Bogen viser, hvordan de sidste århundreders forskning direkte eller indirekte har været afhængig af spørgsmålet om ægthed. I modsætning hertil argumenterer forfatteren for, at den rette forståelse af dialogen bedst findes på baggrund af Platons samlede værk, uafhængigt af forfatterspørgsmålet. Således giver bogen også et overblik over den nyere Platon-forskning og en indføring i en række væsentlige temaer hos Platon. (shrink)

Dette kapitel fokuserer på ’etik og patientinddragelse’, men søger med afsæt i devisen ‘sapere aude’ også at skabe interesse for filosofi og etik blandt sygeplejestuderende. Kapitlet er en opfordring til sygeplejestuderende om at betjene sig af egen forstand og finde mod til at filosofere over problematikker i forbindelse med patientinddragelse frem for at falde tilbage i umyndighedens bekvemmelighed og vente på at andre træder til. Kapitlet starter med at se nærmere på, hvordan patientinddragelse italesættes i vor tid efterfulgt af en (...) kort eksposition af to af oplysningstidens vigtigste libera- le filosoffer, herunder pligtetikeren Immanuel Kant og nytteetikeren John Stuart Mill, hvis syn på henholdsvis autonomi og frihed influerer debatten om patientinddragelse. Efterfølgende præsenteres og diskuteres to eksempler, hvor patientinddragelse og etik er i rampelyset. Mere specifikt rettes fokus på 1) etik, patientinddragelse og den psykiatriske patient og 2) etik, patientinddragelse og unge mennesker. Eksemplerne er udvalgte med henblik på at belyse, hvad der kan komme på spil i sundhedsfaglige situationer udspændt mellem individuel frihed, herunder også ideen om autonomi; sygehusvæsenet, inklusive personale, som autoritær vi- dens-institution/aktør og det etiske, herunder ideen om ’det gode’ eller efterstræbelsesværdige. Afslutningsvis argumenteres der for, at sundhedsarbejdere med blik for etik og patientinddragelse kan udgøre en positiv kraft for den inddragede patient, men at det kræver, at denne vover at være vis. Bakgrunn: Preimplantasjonsgenetisk diagnostikk er en genetisk undersøkelse av befruktede egg før de settes inn i livmoren i forbindelse med assistert reproduksjon. Hensikten med PGD er å unngå at det fremtidige barnet får en alvorlig arvelig sykdom, og at par som på grunn av arvelig sykdom har vansker med å få barn, kan få avkom. PGD er kontroversielt og et sentralt tema for den pågående vurderingen og revisjonen av bioteknologiloven.Metode: Paradoksteori anvendes for å identifisere og analysere noen av kontroversene ved PGD. (...) Det skilles mellom tilsynelatende paradokser, antinomier og aporier. Materialet er offentlige dokumenter, debattinnlegg og faglitteratur.Resultater: Det finnes en rekke tilsynelatende paradokser på PGD-ens område, slik som at PGD gjøres selv om det er svært liten sannsynlighet for at det blir født et alvorlig sykt barn, og at det gjøres PGD for mindre alvorlige sykdommer når forutsetningen for PGD er alvorlig arvelig sykdom. Samtidig finnes det også antinomier: At PGD gir rett til helsehjelp uten at det eksisterer noen pasient, og at PGD gjennomføres selv ved høye kostnader og lav suksessrate. Om embryoet og fosteret har moralsk status og rett på beskyttelse, synes å utgjøre en apori.Konklusjon: Å formulere moralske utfordringer som paradokser kan være en fruktbar måte å tydeliggjøre utfordringer og motsetninger på. The purpose of using PGD is to help people avoid having children with serious genetic disease and to help those with genetically based infertility to have children. PGD has been controversial and is assessed as part of the revision of the Norwegian biotechnology act.Method: Paradox theory is used to identify and analyse controversies with PGD. It distinguishes between resolvable paradoxes, antinomies and aporias. The material comprises official documents, public debates, and professional publications.Results: Many resolvable paradoxes are identified with PGD, such as that PGD is done even in cases where there is very little chance that a seriously ill child will be born and in case of diseases that are not considered to be «serious inheritable disease,» as required by the law. At the same time, there are antinomies: PGD is subsumed within a patient's rights even if there is no patient, and PGD is done even when the success rate is low and the expenses are high. Whether the embryo and the foetus have a right to protection appears to be an aporia.Conclusion: Analysing moral problems in terms of paradoxes may be a fruitful way of displaying challenges and conflicts. Moreover, it may give focus and direction to our endeavours. That is, we should try to resolve the resolvable paradoxes and work harder with the conflicts of the antinomies, and, to a certain extent, to accept the antagonisms of the aporias. (shrink)

I was pleasantly surprised to hear that most participants of SAAP use the term "American" in its continental, rather than in the US-centric sense. I am glad that many of the philosophers of this community of knowledge have opened their dialogues to the voices and experiences south of the (...) Río Bravo. We are living during very difficult times in which cultures and practices of violence, as well as aggressive exclusion and intolerance, are affecting our communities on both sides of the border. The use of the historical development of representationalism to pose a central problem in contemporary cognitive science is unique.

Scholars and practitioners across domains are increasingly concerned with algorithmic transparency and opacity, interrogating the values and assumptions embedded in automated, black-boxed systems, particularly in user-generated content platforms. I report from an ethnography of infrastructure in Wikipedia to discuss an often understudied aspect of this topic: the local, contextual, learned expertise involved in participating in a highly automated social–technical environment. Today, the organizational culture of Wikipedia is deeply intertwined with various data-driven algorithmic systems, which Wikipedians rely on to help manage (...) and govern the “anyone can edit” encyclopedia at a massive scale. These bots, scripts, tools, plugins, and dashboards make Wikipedia more efficient for those who know how to work with them, but like all organizational culture, newcomers must learn them if they want to fully participate. I illustrate how cultural and organizational expertise is enacted around algorithmic agents by discussing two autoethnographic vignettes, which relate my personal experience as a veteran in Wikipedia. I present thick descriptions of how governance and gatekeeping practices are articulated through and in alignment with these automated infrastructures. Over the past 15 years, Wikipedian veterans and administrators have made specific decisions to support administrative and editorial workflows with automation in particular ways and not others. I use these cases of Wikipedia’s bot-supported bureaucracy to discuss several issues in the fields of critical algorithms studies; critical data studies; and fairness, accountability, and transparency in machine learning—most principally arguing that scholarship and practice must go beyond trying to “open up the black box” of such systems and also examine sociocultural processes like newcomer socialization. In this paper, the Helmholtz equation with quadratic damping themes is used for modeling the dynamics of a simple prey-predator system also called a simple Lotka–Volterra system. From the Helmholtz equation with quadratic damping themes obtained after modeling, the equilibrium points have been found, and their stability has been analyzed. Subsequently, the harmonic oscillations have been studied by the harmonic balance method, and the phenomena of resonance and hysteresis are observed. The primary and secondary resonances have been researched by the (...) multiple-scale method, and the conditions of stability of the amplitudes of oscillations are determined. Chaos is detected analytically by the Melnikov method and numerically using the basin of attraction, the bifurcation diagram, the Lyapunov exponent, the phase portrait, and the Poincaré section. The effects of all the parameters of the system are analyzed in detail, and special emphasis is placed on the new parameters. Through this analysis, the complex phenomena such as hysteresis, bistability, amplitude jump, resonances, and chaos have been obtained. The control of the parameters and the necessary conditions to control the aforementioned phenomena have been found. (shrink)

I shall understand physical determinism as the doctrine that every physical event has a physical event as its necessary and sufficient cause. This paper seeks to show that no one would be justified in holding this doctrine unless it could be shown to make successful predictions; and that such predictions could only be obtained if we assume the doctrine to be false.

The present comment on Solari and Natiello’s paper values their constructivist approach to Newtonian Mechanics. My critical point concerns only the link between the concept of force and phenomena. It will be shown that the idealised form of the law of inertia created by the authors avoids criticism of the law and that this law leads to the concept of force as the cause of acceleration. This concept appears in the authors’ reconstruction as an assumption. They add that this assumption (...) must be contrasted with experiments. Following this, I address an experiment, in which the force that is taken as the cause of acceleration, is not present in the phenomenon at stake. As it thus does not satisfy the property of locality, which any cause has to, force cannot be a cause. (shrink)

The results generated by experimentalists in psychology and economics haveled to numerous advances in the study of human decision making under risk.Camerer (1995) and Rabin (1998) provide excellent reviews of the relevantliterature. These results clearly display the gap between normative theoriesof ideal behavior and descriptive theories of observed behavior. The mostprominent result is loss aversion – the observation that a loss is given greatervalue than a gain of an equal size – and the resulting S-shaped utility function.Rabin puts the key (...) point as follows: ``Researchers have identified a pervasive feature of reference dependence: In a wide variety of domains, people are significantly more averse to losses than they are attracted to same size gains''(Rabin 1998, 13–14). In what follows, I will show that the ``wide variety of domains'' is wide indeed. In particular, I will review the effects of the S-shaped utility function on the resolution of the decision to commit a crime, to decision to violate professional ethics, and the decision to participate in a rebellion. This chapter affirm a thinking of time as difference. It does not claim to figure time as such, because whatever time is, time remains essentially in excess of figuration. Instead this chapter elaborates instances of the effort to think time as difference in Aristotle, Henri Bergson, and Luce Irigaray. I suggest that each of these philosophers affirms the fundamentally elusive nature of time while also articulating valuable ideas for thinking time as difference.

I argue that the conjunctive distribution of permissibility over or, which is a puzzling feature of free-choice permission is just one instance of a more general class of conjunctive occurrences of the word, and that these conjunctive uses are more directly explicable by the consideration that or is a descendant of oper than by reference to the disjunctive occurrences which logicalist prejudices may tempt us to regard as semantically more fundamental. I offer an account of how the disjunctive uses of (...) or may have come about through an intermediate discourse-adverbial use of or, drawing a parallel with but, which, etymologically, is disjunctive rather than conjunctive and whose conjunctive uses seem to represent just such a discourse-adverbial application. In the coverage of the problems of war and peace in Catholicism, researchers sometimes omit the regional component of their manifestation. We are talking about local traditions in Catholicism, which have their own specific approach to solving this problem and sometimes may differ significantly from the "conventional" position. The study of this field is necessary because in the delineated field the position of those theologians who were on the "outskirts" of Catholicism in the intercultural dialogue, on the one hand, led (...) to a deviation from the humanistic orientation about Catholicism. the war. An example would be the concept of a "holy war" of the Crusades, which had the anti-Islamic rhetoric generated not only in the West but also in the East. (shrink)

Of articles which are submitted for publication in Philosophy, a surprisingly large proportion are about the views of Richard Rorty. Some, indeed, we have published. They, along with pretty well all the articles we receive on Professor Rorty, are highly critical. On the perverse assumption that there must be something to be said for anyone who attracts widespread hostility, it is only right to see what can be said in favour of Rorty's latest collection of papers, entitled, Truth and Progress,.

In I used Turing machine arguments to show that computers can recognize humanly recognizable patterns in principle. In 1978 James D. Heffernan has expressed some doubts about such arguments. He does not question the propositions that I defend in the paper, nor the specific arguments in their support. What he does criticize are certain background assumptions.

Elsewhere I have argued that the notion of a normative agent-neutral reason is undermined by certain views on reasons; the existence of agent-neutral reasons can be questioned. Here I shall not repeat my doubts but rather address a way of expressing the distinction that I had not considered and which would, if correct, put an end to my worries about the soundness of this dichotomy. The idea, which was suggested to me by Douglas Portmore is that normative reasons are facts (...) of a peculiar kind: they are subjunctive facts of a certain kind. (shrink)
